RESPONDENT: Is a person who responds to any SexText.com.au Personal Ad
A response to any SexText.com.au listing by a third party will be taken as an agreement between all parties - Adult.com.au, SexText.com.au Personals, the Advertiser and the Respondent - that all Terms and Conditions as clearly set out, have been accepted by all parties. The private message relay service offers both the Advertiser and Respondent, absolute anonymity if desired.
It is necessary for all persons who choose to use the SexText.com.au Personals advertising, whether as an Advertiser or Respondent, to agree to, and abide by our Terms and Conditions. The lodgment of each and every Personal Ad will be taken as an agreement by the lodging party, to abide by the following Terms and Conditions :-

Members of the public are not permitted under any circumstances to contact any person from this service other than for the purpose for which this service is provided. Unacceptable contact includes, but is not limited to, Advertising, Marketing, Spam E-mails, Selling Goods or Services, or Promoting other Services or Products, or Redirecting advertisers away from this Service etc.
- You must be at least 18 years of age, and reside in Australia.
- You must not use offensive, degrading or socially unacceptable content in any Personal Ad.
- You must treat all Persons with decorum, dignity and respect.
- You must not continue to make contact with another person or persons when it has been clearly indicated by said person/persons that such contact is unwelcome or be discontinued.
- You must treat as confidential, all information contained in all emails and/or messages, which must at all times, have the original author’s consent before being forwarded on to another person.
- You must not use SexText.com.au to send, display or promote any form of advertising material whatsoever nor send or promote any form of Junk Mail to other members, nor use the site for said purposes.
- SexText.com.au will not accept responsibility for any information/material whatsoever transmitted through this site and disclaims all liability, regardless of the form of action, for the acts, omissions, statements, disputes or any unacceptable or other behaviour by any other person, either through Personal Ads, e-mail, chat rooms or through personal contact.
- SexText.com.au provides all members with a private message relaying service to avoid the disclosure of private or identifying information in their listing. However, as Members are given the option of including personal and/or identifying information in a Personal Ad (ie. Instant Messaging Addresses, E-mails, Phone Numbers, Pagers, Postal Address. etc), SexText.com.au will not accept, and will deny all liability arising out of, or as a result of, but not limited to, any such use or disclosure.
- All SexText.com.au listings will run for a period of 12 months from date of insertion, unless removed earlier.
- SexText.com.au reserves the right to reject, remove, or modify any listing for any reason whatsoever.
- You must not use any words in your Nickname or Ad that would imply to another person, or give reason for another person to believe, that you have any association whatsoever with SexText.com.au or Adult.com.au. These words include, but are not limited to, the following :- admin/ manager/ management/ etc.
- SexText.com.au reserves the right to access Chat Room logs and Post Office content at any time deemed necessary, in any event these Terms and Conditions are suspected to be in breach as a result of, but not limited to, Member Complaints, Spam Messaging, Advertising, Corporate Sabotage, or any other extraordinary event.
- SexText.com.au reserves the right to update, modify, change, add to or remove these Terms & Conditions at anytime.

SexText.com.au does not warrant nor make any representations regarding the use of any material on this site regarding its correctness, accuracy, reliability or otherwise. WARRANTY / INDEMNITY
Advertisement submissions are accepted in good faith on the condition that the Advertiser warrants that no material, statement, information or matter contained in the advertisement constitutes a violation of any kind, a breach of any confidence, or contains anything obscene, indecent, libellous, racist, defamatory or otherwise deemed unacceptable, and that its contents and its publication will not in any way infringe the Commonwealth Trade Practices Act 1974 or any other statute, regulation or law whatsoever. Further the Advertiser and/or agent jointly and each of them severally agree to indemnify and keep indemnified the proprietors of Adult.com.au, SexText.com.au and its officers, employees and agents against all claims, demands, damages, costs, penalties, suits and liabilities of any nature howsoever caused whether by negligence or otherwise incurred by SexText.com.au or its officers, employees or agents. The submission, acceptance and publication of each advertisement by SexText.com.au, shall be deemed to be the consideration for the granting of the aforesaid warranty and indemnity.

SEXTEXT.COM.AU'S LIABILITY TO APPLICANT SHALL NOT, FOR ANY REASON, EXCEED THE AMOUNT ACTUALLY PAID BY APPLICANT TO SEXTEXT.COM.AU UNDER THIS AGREEMENT.
